REGULATIONS OF ON-LINE SHOP

I. Definitions
The following terms used herein shall have the respective meanings:
1. Customer - a natural person, a legal person or an organisational entity granted legal capacity under legal provisions that places an Order in the Shop;
2. The Civil Code - the Polish Civil Code of 23 April 1964 (Dz. U. No.16, item 93, as amended);
3. Regulations - these regulations for provision of services by electronic means as part of the online shop OBWARZANEK.COM;
4. Online Shop (Shop) - the website available at https://obwarzanek.com/ through which the Customer may place Orders;
5. Goods - products presented in the Online Shop;
6. Sale Agreement - the Goods sale agreement within the meaning of the Civil Code, entered into by and between OBWARZANEK.COM and the Customer with the use of the Online Shop;
7. Consumer Rights Act - the Consumer Rights Act of 30 May 2014 (Dz. U. of 2014, item 827);
8. Act on Provision of Services by Electronic Means - the Act on Provision of Services by Electronic Means of 18 July 2002 (Dz. U. No. 144, item 1204, as amended);
9. Order - the Customer's declaration of will, directly aimed at the conclusion of the Sale Agreement, defining in particular the type and quantity of Goods.

II. General provisions
1. These Regulations define the principles of using the online shop at http://obwarzanek.com/.
2. The Regulations are the regulations set out in Article 8 of the Act on Provision of Services by Electronic Means.
3. The online shop OBWARZANEK.COM, available at https://obwarzanek.com/, is managed by Alternatywnie.com Sp. z o.o., ul. M.Konopnickiej 28, 30-302 Kraków, NIP (Tax Identification Number): 676-24-82-118, REGON (Statistical Number): 360228170,
entered into the National Court Register maintained by the District Court for Kraków-Śródmieście, 11th Economic Division of the National Court Register under the KRS number 0000533045.
4. These Regulations define in particular:
- the principles of registration and using the account as part of the online shop;
- the terms and principles of placing Orders by electronic means in the online shop;
- the principles of concluding Sale Agreements with the use of services provided as part of the online shop.
5. The use of the online shop shall be possible provided that the teleinformation system used by the Customer meets the following minimum technical requirements: device with access to the Internet
6. For the purpose of using the online shop the Customer should, on its own, gain access to a computer stand or a terminal equipment with access to the Internet.
7. Pursuant to legal provisions in force, OBWARZANEK.COM reserves its right to limit the provision of services through the Online Shop to persons over the age of 18. In such an event potential Customers shall be notified of the above.
8. Customers may gain access to the Regulations at any time through the link placed on the main site of the Website https://obwarzanek.com/, download and print it.
III. Principles of using the Online Shop
1. Registration in the Online Shop shall be optional. The Customer may place an order without registering in the Online Shop, after becoming familiar with these Regulations and acceptance hereof.
Registration shall be effected by means of completing and accepting the registration form available on one of the websites of the Shop.
A condition for registration shall be agreeing to the content of the Regulations and provision of personal data marked as required.
OBWARZANEK.COM may deprive the Customer of the right to use the Online Shop and limit its access to the resources of the Online Shop, in the whole or a part, with the immediate effect, in the event of violation by the Customer of the Regulations, and in particular in the event that the Customer:
- provided, at the time of registration in the shop, untrue, inaccurate, invalid, misleading data or data violating third party rights,
- violated, through the online shop, personal goods of third parties, in particular personal goods of any other customers of the online shop;
- behaved in any other way considered by OBWARZANEK.COM as not complying with applicable legal provisions or general principles of using the Internet or as violating the good name of OBWARZANEK.COM.
A person deprived of a right to use the online shop may not make another registration without a prior consent of OBWARZANEK.COM
2. For the purpose of assurance of security of transfer of messages and data in connection with the services provided as part of the Website, the Online Shop shall take technical and organisational measures corresponding to the degree of hazard to the security of the rendered services, including in particular measures aimed to prevent unauthorised gaining and modifying personal data sent on the Internet.
3. In particular the Customer shall:
- supply and provide no contents that are prohibited under legal provisions in force, e.g. contents promoting violence, libelling or violating personal goods and any other rights of third parties,
- use the Online Shop in the manner that does not interfere with its functioning, in particular by using relevant software or equipment,
- take no actions consisting in sending or placing as part of the Online Shop unordered trade information (spam),
- use the Online Shop in the manner that does not disturb other customers or OBWARZANEK.COM,
- use all and any contents placed as part of the Online Shop only for its personal use,
- use the Online Shop in compliance with legal provisions applicable in the territory of the Republic of Poland, the provisions hereof and general principles of using the Internet.
 
IV. Procedure for concluding the sale agreement
1. For the purpose of conclusion of the sale agreement through the Online Shop, enter the website https://obwarzanek.com/, make your choice by taking successive technical activities on the basis of the messages displayed for the Customer and information available on the website.
2. The Customer shall choose Goods by adding them to the basket.
3. At the time of placing an Order, the Customer may modify the introduced data and the Goods chosen until pressing the button to confirm placing the Order. For the purpose of modification, the Customer should follow the information displayed and the information available on the website.
4. After the Customer using the Online Shop has provided all necessary data, the summary of the Order shall be displayed. The summary of the Order shall include inter alia the description of the chosen goods or services, the total price and any other costs.
5. For the purpose of shipment of the Order the Customer shall accept the content of the Regulations, provide personal data marked as required data and press the button to confirm placing an Order.
6. Information on Goods, available on the websites of the Online Shop, shall constitute an offer within the meaning of Article 66 of the Civil Code. Sending an Order by the Customer shall constitute a declaration of will to conclude a Sale Agreement with OBWARZANEK.COM in compliance with the content of the Regulations.
The agreement shall be deemed concluded at the time of the receipt of the Customer's Order in the IT system of the Online Shop, provided that the Order complies with the Regulations. Following the conclusion of the agreement, the Customer shall be sent an e-mail with confirmation of all significant elements of the Order.
7. The Sale Agreement shall be concluded in the Polish language, of the content corresponding to the content hereof.
V. Delivery
1. Delivery of Goods shall be limited to the countries of the European Union, except Cyprus, Malta, Portugal, Croatia. Goods shall be delivered to the address indicated by the Customer at the time of placing the Order.
2. The ordered Goods shall be delivered through:
- courier service
- parcel machines
The ordered Goods may not be collected in person from our shop.

3. The maximum delivery date shall be 2 business days of shipment, counted from the date of sending an Order by the Customer.
4. Customers may gain access to the Regulations at any time through the link placed on the main site of the Website http://obwarzanek.com/, download and print it.
Recording, securing, making available and confirming material provisions of the Goods Sale Agreement to the Customer shall be effected by sending to the e-mail address indicated by the Customer and by attaching to the shipment containing Goods a printout of the confirmation, specification of the Order and VAT invoice.
VI. Prices and terms of payment
1. Prices of Goods shall be provided in Polish zloty and include all components, including VAT (with definition of the rate), excise duties and any other components.
2. The Customer may settle the price:
- by transfer
- COD (available in the event of shipment of goods within the territory of Poland, extra charge for COD option shall be PLN 5)

VII. Right to withdraw from the agreement

VIII. Complaints about Goods
1. OBWARZANEK.COM, being the seller, shall be liable to the Customer being a consumer within the meaning of Article 22[1] of the Civil Code, under warranty, for defects in the scope defined in the Civil Code, including in particular in Articles 556 and 556[1]-556[3] of the Civil Code.
2. Complaints resulting from violation of the Customer's rights under legal provisions in force or under these Regulations shall be directed to: OBWARZANEK, ul. M.Konopnickiej 28, 30-302 Kraków, reklamacje@obwarzanek.com. OBWARZANEK.COM shall consider all and any complaints within 14 days, and in the event of impossibility to do so, the Customer shall be notified within the said time limits of the time the complaint shall be considered.
OBWARZANEK.COM is not the producer of Goods. OBWARZANEK.COM shall bear no liability for sold goods under the guarantee. The producer may bear liability for the sold Goods under the guarantee under the terms, subject to the conditions and for the period indicated in the guarantee card. If the guarantee document provides for such a possibility, the Customer may pursue its claims under the guarantee directly in the authorised service, whose address is provided in the guarantee card.
IX. Complaints in the scope of the provision of services by electronic means
1. OBWARZNEK.COM shall take actions aimed to assure fully proper functioning of the Shop in the scope resulting from the current technical knowledge and undertakes to remedy, within reasonable time limits, all and any irregularities reported by Customers.
2. The Customer shall immediately notify OBWARZANEK.COM of all and any irregularities or interruptions in the functioning of the website of the Online Shop.
3. The Customer may notify of any irregularities connected with the functioning of the Shop in writing to the following address: OBWARZANEK, ul. M.Konopnickiej 28, 30-302 Kraków, reklamacje@obwarzanek.com.
4. In the complaint the Customer should provide its full name, correspondence address, type and date of occurrence of the irregularities connected with the functioning of the Shop.
5. OBWARZANEK.COM shall consider all and any complaints within 14 days, and in the event of impossibility to do so, the Customer shall be notified within the said time limits of the time the complaint shall be considered.
X. Final provisions
1. Any disputes between OBWARZANEK.COM and the Customer being a consumer within the meaning of Article 22[1] of the Civil Code shall be subject to determination by courts in compliance with relevant provisions of the Civil Code.
2. Any disputes between OBWARZANEK.COM and the Customer that is not a consumer within the meaning of Article 22[1] of the Civil Code shall be subject to determination by a common court for the registered office of OBWARZANEK.COM.
3. To matters not provided for herein the provisions of the Civil Code, the provisions of the Act on Provision of Services by Electronic Means and other relevant provisions of the Polish law shall apply.
